It seems that buyers are now able to get free items on eBay with PayPal’s assistance.

A few weeks ago a buyer bought an overhead projector from us and paid via PayPal. The package was shipped within 10 days via UPS. A week after the package was delivered, we got an email from PayPal that the buyer has filed fraud claim against us for non-delivery of goods. The email instructed us to provide proof of shipping, plans on issuing a refund, or intent to ship goods. The information can be provided via fax to the number provided, or by click reply to the email. (No more link to go to the website and input the information).

We replied to the email immediately with the shipping information and got this response.

Finding that the email PayPal provided was a dead link, we printed the information and fax it to the number provided. We also emailed a copy of the email and the shipping information to Damon asking to check on this because the email address was not good. After 4 weeks we got an email stating that since we did not provide the requested information the money was refunded to the buyer and we will be charged a $15.00 fee.

We contacted Damon immediately asking what is going on; he told us that he had forwarded the information to the appropriate department previously and he does not know why they did not receive it to confirm the shipping and receipt of the package, but they will appeal it and it will take 75 days. They had the shipping information for 4 weeks and did nothing, why should I expect them do anything for another 75 days? PayPal’s excuse is that the product was not shipped within 7 days. WHEN WAS AN AGREEMENT MADE THAT PRODUCT WILL BE SHIPPED WITHIN 7 DAYS, AND WHO MADE THE AGREEMENT?????

Now the buyer gets to keep the product and get their money back via PayPal, meanwhile we have lost our product, our listing fee, our Final Value Fee and plenty of time.

read seller protection,seller must ship within 7 days after payment has been received.
if projector is delivered,ups must have the signature receipt,did you ship to confirmed address??
is this a drop shipment??then you are at the mercy of your dropshipper,unless you know your dropshipper well and know they are well stocked,else you have no control when the item will be shipped.
in the future,do not use paypal for large amount ,especially drop shipment.
you can file for final value fee refund as this transaction did not go through.
good luck,i think you still have a chance of winning if ups shows signature delivery to confirmed addr.

Answer:

"Seller Protection Policy Change

Notice Date: April 11, 2002
Effective Date: May 11, 2002
Effective 5/11/02, sellers are required to ship within 7 days of receiving payment to qualify for PayPal's Seller Protection Policy."

You made the agreement when you signed up with Paypal that the agreement could be amended/changed when they wished. They implemented this change May 11, and gave one month notice on the Policy Update section of the website.

amzn is worse,they expect you to have the merchandise on hand and ship in 2-3 days.

Regardless, PayPal aided the buyer in the commission of fraud and theft. If the item was ship, according to FEDERAL LAW, the buyer must pay for it, regardless of what PayPal says. Or the buyer must ship it back, regardless of what PayPal says...

If the seller has all the proof, them PayPal is wrong, ACCORDING TO FEDERAL LAW, not PayPal Law.

if the seller has shipped within 7 days,and fulfill other requirement such as signature receipt and confirmed address,then paypal willhave to eat the loss if dispute is settled in buyer favor.
in this case,seller shipped in 10 days,not 7 days ,this gives paypal a reason to avoid eating the loss if chargeback dispute is settled in buyer favor.
at this point,i believe seller still have a chance of winning the chargeback if paypal will fight the case for her.
it is up to the buyer credit card issuer.
why use paypal if you are not willing to play by its rules,it is to your advantage that you do,else you should get a merchant account and deal thru your merchant account provider.

many scam artists have received plasma tv set,overhead projectors,pc,camera,housefull of furniture,diamond and saphire and won the chargeback dispute by claiming they did not authorise the charge and they did not sign for it.
