Check it out.
My fav scam was one I head about going on last Christmas. Auctioned included picture of complete computer system, printer, monitor, etc. Description named brand and model etc and text, "Winning bidder recieves item picture below".
Most bidders assumed there was a typo in that line, or read what they wanted to read. In reality, they recieved just hat, The Item Picture tht was shown in the auction. A nice 8 x 10 glossy even.
That one made the local news since the seller was here.

my favorite was the x-box box that sold for $500.00...all that was pictured or promised was the box and that is all the lady got.
your second question...that would be fraud..but you would have a hard time proving it...
a friend at work got caught in this exact thing...her son paid $2100.00 for a racing engine and the man had already sold it twice before...never any delivery...
her son had to travel to the next state and take the man to small claims court, the police would do nothing.
they were able to recoup half the money because that amount was paid through Paypal with a credit card. The 1000.00 they sent by money order was to be recouped through small claims.
The seller no showed for the court hearing so her son won judgement but he has to find him before he can collect....the seller has moved and they have no info on him.
