I have reported a Seller who sells in a category I list in to SafeHarbor for fee avoidance. Before anyone jumps on me, I don't police my competitors, but when I get questions from Buyers if I have the "matching midget available" to the widget I have listed more than a few times during the course of an auction, I wonder why and do some searching. So, I find this Seller who has all 12 current listings TOS stating "matching midget available". I contact SafeHarbor and ask isn't this fee avoidance and shouldn't these auctions be ended or at least the Seller warned? Nothing, except a blah, blah response from CS saying they are following "established protocols" and they cannot say what action was taken against the Seller. Why have rules if your not going to act on them? If ebay has established the rule that offering to sell items outside of ebay in your TOS is fee avoidance, then there should be a course of action - warning and/or auction ended. I asked if someone higher up on the food chain could look into this and I was told do to privacy policies, they cannot tell me what action they have taken against this Seller, if any. Well, I can see what action they have taken - nothing, since all 12 are still running. And, don't even ask about keyword spamming. Seller's who sell real Shabby Chic items have given up reporting non Rachel Ashwell items to Safeharbour. They can't even decide on who the VERO holder is. Yes, I am trying to put this in perspective with our National crisis. But, this is another example of somebody not doing their job, poor work ethic and "I don't give a s*it" attitude! I hope the ebay CS staff I have dealt with have no aspirations to work in airport security, military or intelligence services. Between the AfA campaign and the lack of Customer Support, ebay has really shown its true colors to the Sellers who are responsible for their existence. And they aren't Red, White and Blue!

A fee avoidance has to be so blatant that even a moron could see it. Say $50 to ship something that is $5.00 to ship. If there is any doubt, SafeHarbor will not act or often they will make the seller change their terms. eBay should be giving out 30 day suspensions rather than playing "let's play nice, chidren" tactics.
