What would you do if you won an auction that cost over $220.00 including S&H. You paid by paypal and three weeks later still no merchandise? I emailed the seller and he/she said that it had been mailed gave me a date and then later on gave me a different date. Seller stated that boxes don't just disappear and that I had to have had to received it. I offered a signed statement from the post office that it had not been delivered. He/She said that they would just mail out another one. Sounded fishy to me. Anyone in their right mind would not just mail another $220.00 worth of merchandise. I told seller that if I didn't receive it by a certain date that I was going to file a fraud report. That date came and went and still no merchandise. I filed the fraud report. I got a very rude and nasty email that threatened me that if I did not cancel the report he was turning me over to his attorney for defamation of character. This seller had had negative feedback for this type of problem in the past. Fianlly 6 1/2 weeks of close of auction I finally get merchandise. I would like to leave him negative feedback to let others know that this seller is still up to his/her old tricks. I had to block my email from this person. I was get email that I was being cursed at. Hubby says I should just let it go. What would you do?

Leave the negative (but be aware that he will probably retaliate).

Leave it very politely:
"Merchandise not sent until AFTER fraud report filed"

Yes leave a neg and send all the e-mails he has sent you to safe harbor. If they are as offensive as you state he will be naru 'ed as well he should be.

DO NOT MENTION FRAUD IN YOUR FEEDBACK!!! Mentioning Fraud Safeharbor or any Ebay investigation whether or not it's true is grounds to have the neg removed---but the retalliatory neg to you will stay. Just mention that seller had to be pressured to send the item six weeks after payment. Definitly neg!!

Thanks for the feedback. I did forward all of the cursive emails to ebay. They said that they do not deal with emails between two individuals. Thanks again for the input!!

Celticmuse, When ebay removes a negative it also removes the other negative. Ebay's program doesn't allow just one side of a negative to be removed.

What I have done is send an email to the seller that you must receive the merchandise or a full refund by XX date, and that if you don't you will file a fraud report with ebay and with the Internet Fraud Complaint Center at www.ifccfbi.gov and be sure to include the address for the seller. I had a seller who ignored my emails until I sent an email that stated that I would take these actions. Don't get emotional in the Email. Stick to the facts, tell the seller that they have committed fraud and that you have no problem in reporting them to an agency that is operated by the FBI.

Be sure to follow through. $220 is a lot to loose. The IFCC can help you get your merchandise or money back. You can even call the police in his city and report to them that this person has committed fraud on the internet by accepting $220 from you and not sending the merchandise.
