I would no longer deal with him if he said I was trying to screw him. You have waited more than long enough.

Did you use your Credit Card to pay?

Has he been listing more auctions since he became too ill to do shipments?

Report it to ebay as they may have other complaints and it will be on his record. You can find some help here. Good luck!

Personally, as angry as I'd be, I'd accept the items. I had a seller wait three weeks to mail an item once. Claimed illness and weather as well. Could be that he thought he had mailed it, but didn't and now doesn't want to admit it. I've done that, too. However, I figured out before this long. I'd accept and move on. It's not worth the trouble. Has he left feedback for you yet? If so, I'd leave him a neutral explaining how long it took to ship the item(s).

if he accepted your paypal payment,he has 7 days to ship, not 24 days.
if you want to file complaint, you better do it now.

I would give him the benefit of the doubt and wait a bit. If you have 30 days before a chargeback then give him 29 days. Just make sure you file for a chargeback before the 30 days are up.

There have been several storms in several parts of the country over the past few weeks and although we hear about the storms we don't hear about the cleanup and how long it takes sometimes.

Maybe this guy is ill and is slow on top of that and I'm sure he knows the rules. Although several people have complained about PayPal, we have never had a problem in the three years we have used them so hopefully you can get a chargeback if he goes over the deadline.

kozersky: Yes, I would definitely refuse the items.

After all, it's not about receiving something you really wanted and won at a terrific price; it's personal now and by golly, you've got to make him suffer.

Make sure you file a fraud report with eBay.

Open a SquareTrade case.

Complain to postal inspectors.

Leave negative feedback.

Send email to all his future bidders.

Contact his state's Attorney General's office.

That'll show him, eh?

Since you have a conformation number and insurance number then wait for the package. Just because this guy didn't march to the beat of your drum doesn't mean he isn't trying to resolve his tardiness now. Why would you turn away a package you wanted? You bid on it because you wanted it didn't you?

Get your goodies and move on to the next auction. Maybe the next seller will be perfect.

Hmmmm... this sounds like the wait has allowed "buyers remorse" to set in, and now you are looking for an excuse to kill the deal. No way should it have taken him 24 days to ship after receiving a PayPal payment and he probably has a well deserved NEG coming to him. But the goods are on their way and now you are trying to kill the deal.

If nothing else, if it was me, I'd remember the old saying "a bird in the hand..." HE has your money, you already don't trust him, at least (hopefully) YOU will have the goods you bid on. You really want to try to get your money back? How much is your time worth to you?

Either you're in business or you ain't.

You have 30 days from when the charge appears on your bill to institute a chargeback with your credit card. Not sure what the paypal procedure is but I would rather have the option of calling MY credit card company than proceeding thru paypal.

Did you pay by credit card? If so, just do a charge back through your credit card company and you might want to start the complaint process now with paypal... nothing says you can't cancel.

I don't understand you're not wanting them now? Didn't you want them when you bid and won?

I lost on out on all possibilities of support from both PayPal and eBay because I gave a guy too much time to make it right. He kept agreeing with me and making promises that he didn't deliver on. I finally filed on postal service insurance and he "wouldn't assist in the claim process" so the PO denied my claim. I have a product that does not work and no way to get my money back. He is no longer a registered user. Doesn't help me any. Based on this experience, I will never buy a big ticket item on eBay again. Paypal protections are a farce, too. Rule of thumb for me on eBay: Buy it, but don't expect the same protections as if you bought from a reputable retailer. Feedback is not a good indication of how a seller works because some people won't post negative feedback. Others post a neg at the drop of a hat. Buy big ticket items in your own area where you can look the seller in the eye.

Was this a PayPal instant payment or a credit card ppayment. If it credit card, you can still dispute via your credit card company.

I'm truly sorry to read about your woes. Please don't let that reflect on other EBay sellers. The vast majority of them are fair and honest people who are just trying to make a living. I hope this experience has not scared you away. Blessings to you.

u have 30 days to file complaint with paypal,he is expected to ship in 7 days after paypal payment.
but if he does not have any fund in his account, and he probably does not, paypal cannot recover the fund for you.
you will have to file dispute with your credit card issuer.

it is never a good sign when an ebay seller drags his feet shipping the item.true, some sellers ship once a week, some live far from post office, but this one sounds like he does not have the item or hard to come up with the item.
did you read his feedback?/

you should file paypal complaint now before it is too late,it will protect you if the item does not arrive and seller cannot prove he has shipped.
but you said he has trackable dc.
but paypal said ship within 7 days,so his dc may not be valid if you have not received it so far.
second, paypal is now involved in content issue, you can return the item with trackable dc and request seller to refund.not sure if he refuses, then paypal will force him to refund.
i think it will go on his record, but you have to check with paypal to see if they will force him to refund if you can prove you return with trackable dc.
-you may be able to refuse shipment and then told paypal you want him to refund,as he did not ship within 7 days after payment received.

how can you tell if he has deleted your aol message??
i am on aol as well,i can tell when he read the message, but deletion??
if paypal is refunding your money in full,i would not go to post office and complain.post office is not a social worker or detective,he said/she said about album size and condition and where you bot it,the attitude is that if you bot it on ebay from someone you dont know and for items you have not seen, you get what you deserve.
ebay is a fleamarket, take your chance, learn your lesson and move on.
you want nice stamp album,go to an established dealer and pay the price.
