I bought an item that was $48 including shipping.(it was a fixed price listing) The seller only sent one email. It was 6 days after I paid (aug 30)and it just said "item has shipped will get tracking # asap"
They won't reply to emails and their phone number is just a voicemail box.
I started a paypal dispute hoping that would get them to reply but still nothing. If I go through with the paypal dispute then paypal will keep $25 for their fee. Is there any way to avoid this fee? (I forgot to switch to credit card when I paid)

I would report them to eBay for invalid contact information, meaning the phone.

eBay has -- or had, this may have changed -- an automated phone verification system that forces the seller to be at his phone and actually answer it.

Once you've gotten his attention this way, he'll probably be more amenable to resolving your issue.

I thought they charged the seller 20 buck for chargebacks not the buyers. May be wrong in amount but I think the buyer gets all their money back ? unless they loss chargeback maybe.

If you win the dispute PayPal will refund ALL of your money. They don't take any of it. They may charge the seller, but not you.

If the seller cannot produce an online trackable delivery confirmation,then Paypal will refund you in whole (48 dollars),unless there is no money in the seller accout.
If seller continues to use his Paypal account to accept payment,any fund coming into his account will come to you until you are paid .

Now I know why pay pal is so interested in this process.

When , as a seller, you get these things you only have two choices and one is give them their money back.

They (pay pal) get $25 for not allowing you to fight your claim.

they really are a pack of thieves!

As a buyer, I was never charged $25 for getting my money back.

Did you get a message like the one I posted when you filed the dispute? Their buyers protection is completely worthless on anything under $25.
It is bad enough that they are going to take the first $25 and then I can get up to $23 back out of whatever is left over.

A. ALWAYS pay with credit card when paying by PayPal. That way, if you have to file a claim you do not have to worry about PayPal making good on their buyer protection because Paypal knows that if they do not satisfy you, you can do a charge back on your credit card.

B. Do as Fluffy says and report them to ebay for invalid contact info.

I recently won an "item significantly different than description" claim. Seller rused to respond to me or PayPal. It did not cost me $25.00 but I had used my credit card.

Did you file the claim through eBay? That could be why you are seeing the possible $25 fee. I think I read the eBay fee blurb and decided to file directly through PayPal.

There is no mention of a $25 on PayPals resolution page. PayPal Policy

I usually use a credit card. I just forgot to switch it that time. I wish there was some way to make it default to credit card instead of instant transfer.
I think I filed the dispute directly at paypal. Is there even a way to do it through ebay if you pay with paypal?
Will it do me any good to report them for invalid contact info? They haven't been bidding or selling anything since then and had been fairly active in both before that. I am thinking that something might have happened to them. All I want is ALL of my money back or the item.

If I just go ahead and escalate the claim, is there any chance I can get all the money and not lose the $25? I have been waiting, hoping that the selling would respond.

According to this, it looks like paypal only covers some transactions. Is this true?

It is true that paypal only covers certain types of claims. You are safe on most tangible items. What did you purchase?

Regardless, DO escalte the claim and get the ball rolling and DO contact eBay. The seller should have contacted you by now if they had intended to honor the transaction.

Is the seller still selling on Ebay?
What does his feedback say??
It is likely the seller does not have the item on hand and is stalling.
You can also file with USPS mail fraud dept,a copy will go to his local police .

It was a cell phone.
His feedback is only around 30 but it is 100% positive. He had an auction that ended after this one but that is all. He had been bidding on items till about the same time too and that also all stopped.

Sounds like drop shipping,he has to get the tracking number from the dropshipper.
Is this a new or used cell phone?

It is used.
I don't think it is a drop shipper. The items he was selling were all used and al completely different from each other.
