I am curious to hear what you guys think is the appropriate way to handle this situation.
I sent an item a bidder won from me and it ended up getting slightly damaged in shipment. My buyer is demanding a 100% refund from me even though she chose not to insure the package. I am of the opinion that I am not liable to give the refund. What do you think?
More often than not I would offer a refund just to avoid potential neg feedback, but she is being very difficult about this.
She has now filed a PayPal claim against me on this item claiming it was "not in described condition". PayPal has never sided with me in the past and I have to reason to think they will this time. Obviously a damaged package will effect the condition of what is inside the box. Can she use that as a legitimate claim against me?

I may be wrong, but you should be fine with PayPal if you sent this item to a verified PayPal account holder who used a confirmed address, and you have a delivery confirmation number. Otherwise, if you sent this to an unconformed address or if you don't have delivery confirmation, you will most certainly lose the dispute.
In this particular case, if the item the person won is still usable, why not offer a partial refund?
Without more details in regards to the item or the way you handled the packaging, it's hard to offer an opinion.

Paypal will probably side with you on this one as you can show that she didn't insure and it was offered. I had a friend that had the very same thing happen and she won the Paypal dispute.

Still, even if the address was unconfirmed or if there is no confirmation of delivery, insurance or not, PayPal will usually side with the buyer.

I won a PayPal dispute just like this a while back. Buyer wanted 100% refund for damaged goods that they opted not to insure. Box looked like it had been run over by a Mack truck and the contents were destroyed. PayPal sided with me and agreed that the buyer should have purchased shipping insurance.

wHAT i USED TO DO, JUST TO avoid PROBLEMOS LIKE THIS, IS TO insure EVERYTHING, regardless as to whether or not the buyer paid anything for INS!
With DSI, INS is dirt-creap -- well worth the peace of mind...
