A buyer is PO'ed because I didn't mark her item as a gift and she had to pay $60 extra for customs. This is after 3 weeks of daily emails wanting to know where the package was - NOT in my pocket so what do you THINK!!! She picked economy not me!!!
I explained that she didn't ask me to mark it as a gift and as it was insured for the full amount with USPS - I had to listed that as the value.
Now she's saying "my error" costed her $60 plus there was damage that wasn't listed which will cost her more to repair.
Of course she named 2 things that were listed and one which didn't exist when I packed it to ship.
My TOS state I don't mark items as a gift and I think she is lying about the damage. I think I'm DONE with her. She paid with a money order.
Can I tell her to file her own claim as I don't want to deal with her???
Somebody stop me before I tell her what I really think.

Not your problem. Buyer's responsibility to pay for import tax and duty. Since she thankfully didn't pay by PayPal or credit card she has no recourse to make fraudulent claim for pre-existing damage.

I was thinking of sending her something like this:
Dear B
If there was an error it was on your part not mine as it is clearly stated in all my auctions that I don't mark items as gifts as this is illegal.
As for damage - I listed as follows "THERE ARE A COUPLE OF HOLES IN THE BACK AND THE WREATH IS NO LONGER ATTACHED TO THE COLUMN - ONE OF THE OF THE BRACKETS ON THE STOOL IS MISSING"
If the hand was damaged it was done during shipping so I would suggest you file a claim for reimbursement as it was fine when I shipped it.

I will explain to them that this is a common practice for your online purchases, and ask them to mail you a clarification of the rule that allows this practice, along with a copy to me for my future reference. In the future, you will be able to send a scan of the letter to Ebay sellers to assure them that this is a legal and acceptable practice with the Customs Bureau in your country."

Lady...Go for it. Anyone who intentionally tries to defraud their own government is a common thief. They deserve no courtesy or co-operation from anyone, least of all an honest person they try to get them to help with the conspiracy. All they deserve is the attention of a prosecutor.
