Reading the thread on the seller protection policy, I just wanted to comment that the "not as described" text can help the buyer from a negligent seller.

I just bought a pair of widgets as a gift for Christmas. They were NEW in the box. The seller was informed these were gifts as well (he had emailed me after I paid telling me he'd run out!). He found some more and got them shipped.

However, here's the problem.

He took both widgets, in their packaging, and taped them together with vast amounts of packing tape. Then he slapped a UPS label on this and shipped them.

So my wife (who the gift was for), gets a package on the doorstep with the Widget displayed on every side of the box. Bad enough. But since the commerical packaging was used to ship (instead of properly boxing they items), the boxes have been dings and dented in transit AND the tape all over the boxes renders them useless now to give as gifts.

So I lost the surprise and the packaging. Net result: the Widgets, when received, were no longer in the NEW condition I ordered.

Now comes the dispute. He claims not to guarantee the condition of the box -- however he does not say that in his ad. To me, the packaging *IS* part of the product itself and is expected when in NEW condition. Therefore the product IS damaged, whether working or not.

He refused to ship new ones and reclaim the old ones. Therefore my only recourse was to go through Paypal and seek reversal of the cost. I included a settlement offer as well, if he wants me to just keep the used merchandise. Hopefully Paypal will side with me in this case -- as the items are completely useless for their intended purpose.

you just dont get it-
you cannot file a complaint with paypal claiming item not as described as paypal does not get involved with quality /content issue.
But,if you do a chargeback with your cc company telling them what a jerk this seller is and the items are no good (quality issue),then paypal will take your money back from the seller and slap him with a 10 dollars chargeback fee,paypal will tell the seller he lose as you file a complaint as item not described with your cc company.
yes,go ahead and teach this seller a lesson on sloppy packaging.
if he is so cheap as not to find you a box,he deserves to be fined with10 dollars fee plus lose his merchandise and shipping.

Don't be surprised to find your PayPal account frozen if you do make that chargeback without going through proper PayPal procedure however. And even then it doesn't work well for sellers..

well,may be just forget about it and go to bestbuy,target,sears .
how much are you saving by buying from this seller and how much did you pay for shipping??

Good luck on the charge back from Paypal, They will make you jump thru loops of fire, swim vast oceans, march into the depths of hell and slay the devil himself and still tell you NO, you haven't done enough. Go to your credit card company and get your money back from them.

Well, it stinks that you cannot pay with a credit card via paypal if you have a balance. And I usually carry a balance to keep the cash at the ready for online purchases. But when you want protection, you cannot tell them to avoid the paypal balance and charge a credit card.

This item is no longer sold in stores, but still made by the manufacturer.

There really is no excuse for the items being sent to you the way they were especially since you explained to the seller that they were gifts. I've sent out numerous items this month with requests for gift wrapping and gift cards. I've done it knowing these items were being sent directly to other people as gifts. So it took 5 minutes more to slap on some wrapping paper. I'm up to my eyeballs in wrapping gifts anyway so what's a few more? The post office is overwhelmed and they definitely aren't going to take time out to make sure packages arrive in tip-top shape if they aren't properly packaged. A few bad apples spoil it for the bunch.

It doesn't matter with UPS.
He could have put them in Brand New double boxes and they would have still been hanging out when you received them!

Very rare I receive a box from UPS that doesn't look like it was run over somewhere along the line!

Cheryl is right. I have shipped 40 + pkgs in the past month. All were packed with care in bubblewrap & packed in peanuts. So far everyone has gone through in perfect condition. Have 2 left to ship & shipped 3 today. Nothing but + feedbacks so far. Doing a good job of packing a sale is half the job of selling.

Depending on the type of item, the original carton and it's condition can double the value of an item if it's a collectable.


The light at the end of the tunnel will turn out to be an oncoming train.

I got one package today from UPS in perfect condition - not sure about the other package though - it is at some business six bocks from me. Good thing I decided to check on its progress to see if it was safe to go shoppig tomorrow and found out it had been delivered 5 hours earlier just not too me. add three hours of me terrorizing UPS and we tracked it down, just in time for the business to be closed. Sometime tomorrow I'll report back on it's condition : )

Every box I have received from a seller sending UPS has come in terrible condition. Two times in one week the items were broken although they were boxed well. There's no excuse for it.
