Jack,
Just a question: is there ever a reason for non-payment? Shipping gouging, or you find out after winning auction, product is not EXACTLY as described? (i.e. auction says MINT, and at EOA seller emails and says btw, there is one small chip, scratch, etc. on the thing?)

What then??? (Just asking here......)

If the seller did change the condition of the item in their EOA, that would be an interesting thought to not pay for something you bid on...

However, I don't see many sellers saying that AND not offering the winner a way out... so would not be an issue.

and the age old question "shipping gouging" if the cost isn't listed and you didn't ask... well just because you "feel" the shipping is to high, that is NOT a valid reason not to pay.

Twelve, who is "feeling" anything?

A buyer who is a seller "knows" what the approx shipping should be.

I never mind doing low cost on the item (i.e., penny or .99) and letting the seller make full profit on shipping. But I do mind paying normal value for item and then more than 5 overage on the shipping.

But maybe thats just me.

I say again, "if it is not listed and you didn't ask"... you are obligated to pay.

However you can report the seller to eBay for shipping violations...

To play the Devil's Advocate here a bit, technically the buyers are required to pay but ebay makes NPBs are pain so at a minimum the buyers can forego paying for at least two auctions in a roling six month period without incurring a suspension and probably many more as a LOT of sellers do not file for the NPBs. The threat of a negative feedback or return negative keeps many of the deadbeat's feedback records fairly clean too.

All weaknesses in the ebay suit of armour.

As much as I feel your pain Jack, ebay is never, ever going to do this. They'd be in the middle of a million "he said/she said" arguments every day. They're "Just a Venue" remember

I agree with the last post.

I don't understand why they couldn't do it?

All it would take is as soon as bidderX has an NPB placed against them, their ability to leave feedback is not available.

That would be an easy script for some programmer...

It would be only for that auction and taken away if the seller removed the NPB.

Why would there be a "He said/she said"? NPB filing doesn't allow for arguments...

You're assuming that every case is clear cut and every seller is completely honest. Anything less is simply ebay taking sides, and they just ain't. gonna. do it.

The he said/she said comes in when the buyer writes to ebay raising holy heck because they "sent their payment!! It's cashed even!" See what I mean about it looking like ebay has taken sides? Right or wrong, that's what it is. "The seller said you didn't pay. Too bad. We're not listening to you." There are too many scenarios where this would not be fair.

Fraudulant sellers are rampant enough. Imagine the following: Dude has 1000 computers. He files an NPB on every one of the people that pay for a computer before they can file feedback. The rest of the bidders have no warning at all, not even our flawed feedback system. Think he'll go at it a little longer than he normally could have? Yup. Of course ebay is going to catch on fairly quickly, but you're still going to be missing those negatives right away.

Don't get me wrong..I'd love to see it happen. I'm just not holding my breath.

Ahhh I see your point about the dishonest seller abusing it...

That does create a different thought.
