The answer is yes, my fault but...

I have my first no pay. Nice response within a day or two promising a MO. Auction ended 9/21 - can I still notify ebay and neg the buyer? I already sent two emails that were not answered. My TOS does not have time limits - they will tomorrow.

Since this is only 9/17, I don't think your auction has ended yet. But, I think you may have meant 8/21. In that case, it's not too late for either. You can send a nonpaying bidder alert and then file for credit. You can leave a negative up to 60 days or as long as the auction is in the system.

If it's 1999, you can no longer leave a negative, but you may be able to file for fvf.

C/P'ed directly from the Ebay Non-Paying Bidder Page:

"...you must complete a Non-Paying Bidder Alert Form within 45 days after the end of your auction. "
