Help again! If you put someone on your "Blocked Bidder List", can they still leave you a negative feedback if they won one of your auctions?? I know that it'll prevent them from bidding on any of my other auctions, but will it also prevent them from leaving any feedback? Thanks in advance!

Yes, as long as they "won" one of your auctions as high bidder.

Okay, here's a question for everyone. I've read on these boards a few times when the seller could not sell the item (it broke, was lost, consigner pulled out), and the buyer is upset. Usually, the seller defends himself by saying they provided a full refund, and are doing everything they can to make it up. Fair enough. For some buyers, this is not good enough.

Now, if eBay kicks off buyers for having 3 NPB filed against them, should a seller be subject to the same rules? Say three complaints by buyers that the seller failed to complete the transaction, and the seller is booted. Would this be fair, and why or why not?

I'm not looking for easy answers, I know it's a complex problem. Maybe the rule should be a % of sales for buyers and sellers (should a bidder with 99% positive feedback be kicked off for backing out 3 times?), or 3 in short order, or something else.

You obviously had a bad experince with one or more sellers. The deterrent to rude or incompetant sellers is negative feedback. I'm pretty sure you are not an experienced Ebay seller, as only a buyer who felt they'd been burned would post as you did.

I'm not critical, just curious. What bad experience did you have as a buyer on Ebay?

Sellers do get booted off, for dishonesty. You are trying to make sellers responsible for life's vagaries. Hey, there are reasons that even buyers legitimately are let out of auctions for reasons truly beyond their control, like a death in the family, or a serious accident or illness. Those are actually rare.

But if someone's dog chews up a pair of boots you won a bid on, the seller is being very repsonsible by notifying you, refunding your money and cancelling the sale. Nothing dishonest, life happens. It is a rare occurence as well.

If you are going to fault the seller who did what the honest thing was, then fault the wife who didn't pay for her auction win after her husband died. Are we going to require she send a death certificate as proof? Not me, even though it may be a lie on her part.

Like I said, life happens. One cannot legislate for every situation that might make one party or the other upset. It's just life and human realtions.

Buyers and sellers on Ebay alike eventually get "punished" for dishonesty. Some sooner than others. But sellers should not be punished with some additional measure simply because someone got angry. Many times, the angry buyer is angry at all those around them in life as well, not just the seller, or is a buyer with little real Ebay experience and doesn't thoroughly understand how the system works.

Life is not fair and we cannot make it so, no matter how many laws and rules are written. After all, the seller in your scenario didn't maliciously destroy the item, huh?

Hello All, Twelvepole in my opion knows very little about being a dealer and always has a big chip on his or her shoulder. Always looking for a fight. I just can't take a person like twelvepole seriously but I do feel bad for twelvepole. Life for a person like that must be very hard. Only my opion and I hope I am wrong.

Walmart does have restrictions, I never used to be good about keeping receipts because I figured if I took something back, I did not need cash back a gift card was fine. Well, I think after 3 times, Walmart has a policy where you can not exchange without a receipt. I keep all the receipts now. (Luckily I moved to a different state, and since they go by driver's license number, I get a fresh start, but how often do people do that lol)

Have I had bad experiences as a buyer? No. I've bought about 10 things, all the transactions were smooth. In fact, I've sold more than I bought, although I haven't sold in a couple years. I even had a buyer ignore my ToS- I was selling a computer, and specified US bidders only, but the winner was from overseas. He paid the ~$100 shipping charge, and I dealt with it; I wasn't sure it was gonna work, because the box was technically oversized (not by much).

I guess I was writing about the general idea here that the bid is a "contract" when the buyer makes the bid. So, if that's the case, it's a "contract" when the auction ends, and the seller should be equally obligated to sell as the buyer is to buy. If you sold something and broke it, well, buy another one and ship that. So if the bid is a contract, it's gotta cut both ways.

I understand that everyone needs to be flexible. Items break, people die, and yes, sometimes people don't read all the ToS. We all need to bend a little so that we don't break.


One thing I'd like to add is that I will pass on auctions where I think the terms are unreasonable (or just irritating), or bid much lower than I would otherwise. Mostly trying to head off bad buying experiences before they happen.

If you sold something and broke it, well, buy another one and ship that.

Sometimes it's not that easy if the item is an antique or collectible. And even if you could find another on ebay it may not be the same condition as the one that broke.

And if it's a newer item you may be required to buy a whole case lot from the supplier which may not be a good idea either. Also it may take some time to get it back in stock and the bidder may not want to wait so it's best to apologize and refund right away. I think that most people understand. But I'm sure that there are a few sellers that don't get the bid price they expected and then say the item broke.

But when bidders don't pay because they found it cheaper, changed their mind, didn't read the TOS or numerous other reasons they usually burn more than one seller.

twelvepole, some things are worth being submitted 3 times.

Ebay already has a "non performing seller" policy. In theory, they can suspend a seller for a single infraction if they decide to. There is no 3 strikes rule for sellers. In actual practice, they may or may not investigate a single incident and will probably flag an account for obversation if they see a pattern developing. For buyers, they can't investigate every single complaint because of the sheer volume. Hence the 3 strikes rule. The suspension is done by a computer, not a fair and impartial referee. Buyers and sellers. Apples and oranges. A booted buyer can return in 3 minutes under a new unverified i.d. Sellers tend to want to keep their accounts and reputations as it's rather difficult to start over. And as unappetizing as it is to swallow, it's a fact of life that the seller pays all the fees and the buyer pays none. Who do you think Ebay is going to favor?

Sorry to disappoint you, twelvepole but my responses are my own. Never in my life have I had to be a parrot for someone else and I'm not about to start now. And never in my life have I hung with bullies. My RL has nothing to do with my board life and there isn't a single person here who can jump forward and say that they know me.

You just like to troll the boards pizzin' and moanin' all day in your imaginary little world. I could say that 3 times also, mousepole but most people are bright enough to understand it the first time.

I too sell collectibles & quality china. have never ever had any type of relationship with any of my buyers. I have always been something of a loner. Probably because I moved a lot, so never had time to develope a close relationship.
