So whats the deal with paypal lately?
I got a chargeback from paypal, asking me to supply information to proove I sent a customer a refund...This was in august. I did so (they were refunded by money order BEFORE the case was opened BTW)....and I faxed the money order 5 times! to Paypal. They keep saying they have not received it. The case was closed over a month ago by paypal saying the customer stated it was settle amicably, but they are STILL holding the funds! Now, I called the BBB and my bank AND the DA's office. They all said the limit for the funds to be held is 60 calendar days IF the case is still open - PAYPAL is saying 75, AND is still holding the funds! Now, the DA says that is fraud - by PAYPAL. How the eheck do we HONEST people get our money back?

I can't understand why you sent the buyer a refund via a money order when they used PayPal to send you the payment. Maybe it's just me but that seems like a whole can of worms just waiting to be opened and it seems like it got opened. Whether the idea of sending the refund via a money order was the buyers idea or your idea that was offically a "bad idea."

Good question, why the refund via a money order instead of through paypal, unless there was a problem with the account.

The point is not why did he send the funds back by MO.

The point IS why is PAYPAL still holding the funds when the issue has been settled amicably

Even with my Merchant Account (I will not use PayPal), they tell us to refund any money the same way that it came in. If you used your Visa Card, then I refund on that card. It protects me from a chargeback.

Second, PayPal will only return the money back to him if PayPal wins the Chargeback dispute with the Card Company. If PayPal loses the dispute, then he will not get refunded

In this case, we do not know why he refunded with a Money Order instead of using PayPal. Could it be the account was restricted or was there other problems with the account.

This problem is a problem whether it is PayPal or your own Merchant Account and to eliminate this problem, always refund the same way that they paid.

If your DA's says they are committing fraud, then he should file charges against them in your behalf.
